Right of withdrawal


You have the right to cancel this contract (purchase) within thirty (30) days without giving a reason.

The cancellation period is 30 (thirty) days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
 

In order to exercise your right of withdrawal, you must send a clear declaration to us (Findeisen Uhren, Geiersberg 7, 90403 Nuremberg, email: info@findeisen-uhren.com) (e.g. a letter sent by post or an email) ) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the notification that you are exercising your right of cancellation before the cancellation period has expired; this notification must contain your full name and the date of purchase of the product.

Please note that if you would like to make full use of our 30-day return policy, please do not remove the protective film from the watch, the metal bracelet and the clasp within this period. In addition, please do not shorten the metal bracelet. The watch / product must not contain any damage when returned, no scratches and no signs of wear, which indicate improper handling, wearing or opening of the watch. We can only refund the full purchase price if you follow these instructions and the goods remain undamaged.

 

Exclusion of withdrawal


However, the right of withdrawal may be excluded in some exceptional cases. If prefabricated goods are adapted exactly to your wishes (e.g. the engraving of a watch) or custom-made products are made, there is no right of withdrawal.

Also excluded from the right of withdrawal are products that show damage due to wearing, use or handling, for which the buyer is responsible. The statutory warranty obligation applies to these products, as well as the warranty of 3 years from the date of purchase offered by Findeisen Watches, owner Martin Zettl. 


Consequences of cancellation:


If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within thirty days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods immediately and in any case no later than thirty days from the day on which you inform us of the cancellation of this contract to the address of one of our Findeisen Watches Service Centers given by us in our response to your cancellation . The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.


You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.


1. General


Unless otherwise expressly agreed in writing, all offers, business deals and deliveries are made in accordance with the general terms and conditions of the webshop www.findeisen-uhren.com

Conflicting terms and conditions of the customer expressly do not apply.

Offers are valid as long as they are published on our website. All information is provided without warranty. In particular, there is no claim to completeness for the prices given. Errors, misprints, price and product changes are reserved.


2. Conclusion of the contract


Our offers are non-committal and non-binding. The representations of the products in the online shop are not a legally binding offer, but a non-binding online catalog. We reserve the right to make mistakes in images, descriptions, dimensions, weights and design changes. Images serve only as illustrative material and may differ from the product. The customer's order placed via our website or by e-mail, internet auctions, post or telephone is binding.

After receipt of the order, the customer receives an email confirming receipt of his order (order confirmation). This order confirmation does not yet contain a declaration of acceptance of the contract offer, but is for information only. An effective sales contract is only concluded with our delivery confirmation or the dispatch of the goods.


3. Delivery

Longer delivery times are explicitly stated on the corresponding product pages.
If delivery is delayed, we will inform you immediately.

Information on the delivery date is non-binding on the part of the seller and only represents a non-binding estimate. Fixed deals are not concluded. If the non-compliance with an agreed delivery period is due to force majeure, industrial action, fire, machine breakdown, unforeseen obstacles or other circumstances for which the seller is not responsible, the delivery period will be extended for the duration of these events. This applies accordingly in the event that the seller is in default of delivery when one of these events occurs.


Transport damage that the client discovers after receipt of the article must be reported to the transport company or us within 24 hours of receipt of the article, unless the delivery person has already been notified, otherwise no claims for compensation or replacement deliveries are possible.


4. Prices


The prices apply ex warehouse as individual prices in euros and include the applicable statutory value added tax (VAT), currently 19%, hereinafter referred to as the value of the goods. All prices are valid until a new price list is published.


The shipping costs are included in the price for shipping within the scope of the Federal Republic of Germany and are not added separately to the order value. For European and other foreign countries, the prices from the following page apply accordingly: PAYMENT & SHIPPING . The packaging is included in the price. When delivering abroad, please note that surcharges may have to be expected from customs. Customs fees are generally borne by the buyer.


5. Payment, offsetting, assignment


Payment by PayPal, payment by credit card, payment in advance, payment by Klarna, payment by Giropay. The payment conditions stated on our website, in the offer or in the order confirmation apply exclusively. The customer can only offset such claims or assert a right of retention that are undisputed and legally established. We offer the following payment methods : credit card, Klarna, Paypal, Giropay and prepayment.
 

Credit card
If you have decided to pay by credit card, the credit card information (number of the card, expiry date, etc.) will be automatically forwarded to the Paymaster via an encrypted security system, without Findeisen watches. Inh. Martin Zettl or third parties have any form of access to it. Even if there are any refunds, it is not possible to see the complete credit card details. Therefore, a refund is only possible to the card with which the purchase was originally made. The financial information for credit card transactions (number of the card, expiry date, etc.) is automatically forwarded with an encrypted protocol, without Findeisen Uhren, Inh. Martin Zettl or third parties having any access to it. This information will never be used again, with the exception of refunds in the event of returns. Please note that this is a direct debit. Your credit card account will be charged when your order is shipped. We accept all major credit cards.

PayPal

We currently only offer this payment method for orders in euros.

Select the PayPal payment method during the ordering process, then you will be redirected to the PayPal website. If you do not have a PayPal account, it is possible to open access during the payment process. For more information, please visit PayPal.com. The customer can only exercise a right of retention if the underlying claims arise from the same contractual relationship.

Immediately by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that has been activated for online banking, identify yourself accordingly and confirm the payment instruction to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Giropay
After placing the order, you will be redirected to the website of your bank. In order to be able to pay the invoice amount via Giropay, you must have a bank account that has been activated for online banking, identify yourself accordingly and confirm the payment order to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately afterwards and your account will be debited.


The assignment or pledging of claims or rights by the customer against the provider are excluded without the consent of the provider, unless the customer can prove a legitimate interest.


6. Retention of Title


All delivered goods remain our property until the purchase price has been paid in full. The claims from resold goods are transferred to us in the amount of the original invoice amounts. If the delivered goods or the property on which they are located are attached, confiscated or otherwise claimed by third parties (e.g. as a result of forced administration or foreclosure sale), the customer is obliged to point out our property rights immediately and to notify us in writing immediately to make as well as to send us copies of the seizure protocols.


7. Right of withdrawal


You have the right to withdraw from this contract within 30 days without giving any reason.

9. Guarantee and warranty conditions


The provider is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff. BGB.

With a watch from Findeisen Uhren, owner Martin Zettl, you acquire a unique product with excellent quality features. We give the following guarantee on all our work - and in any other case we will help you as quickly and accommodatingly as possible.

Findeisen Uhren, Inh. Martin Zettl (in short: Findeisen watches) guarantees every person who purchases a watch made by Findeisen from a specialist dealer authorized by Findeisen or in the online shop at (https://www.findeisen-uhren.com) (customer) has, in accordance with the following conditions, that this watch is free of material or workmanship defects within three years from the date of purchase. If, contrary to expectations, such an error should occur within this period, then Findeisen Uhren will repair it at no cost to the customer or - if a repair should not be possible - deliver a new watch to the customer.

In addition, Findeisen Uhren grants a corresponding guarantee of two years on all service or repair work carried out by Findeisen Uhren (except for repairs and repairs relating to water resistance), which begins with the return of the watch to the customer.
 

Signs of wear are excluded from the guarantee, especially on leather, rubber, nylon and stainless steel bracelets. Claims from this guarantee also do not exist if the watch shows damage or defects caused by improper use, or if the watch shows features that indicate external influences or interventions by unauthorized persons, such as improper repair. Furthermore, Findeisen excludes watches from the guarantee:

Theft, glass breakage, loss, force majeure, natural disasters and accidents (blows, bumps, fall damage, crushing, etc.)

  • Damage from mishandling

  • Wear and tear from normal use and aging of the watch

  • Water resistance problems and their consequences.

I. Claiming Warranty

If you would like to make use of the guarantee, please hand over your Findeisen watch, including the original invoice and the completed guarantee card, to the dealer from whom you bought your Findeisen watch. After consultation with Findeisen Uhren, you will be given the address of a Findeisen Watch Service Center as soon as possible (for example by email or phone).

The buyer / owner / customer bears the costs of sending. When shipping, the customer bears all risks associated with shipping, in particular that the watch may be lost or damaged during shipping.


II. Governing Law

The law of the Federal Republic of Germany applies to this guarantee. This guarantee does not affect the customer's statutory rights due to a defect in the watch.


10. Data storage / data protection


We inform our customers that we will save and process their data - insofar as this is necessary for business and permitted within the framework of the Federal Data Protection Act. The data will not be shared with third parties.

We only use your inventory data to process your order. All customer data is stored and processed by us in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). You have the right to free information, correction, blocking and deletion of your stored data at any time. Please contact info@findeisen-uhren.com or send us your request by post.

We do not pass on your personal data, including your address and email address, to third parties without your express consent, which can be revoked at any time. This does not apply to our service partners who require the transmission of data for order processing (e.g. the shipping company commissioned with the delivery and the credit institute commissioned with the payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum (Name, address, email address and phone number for shipment status notifications).

We use technical and organizational security measures to protect your data managed by us against accidental or deliberate manipulation, loss, destruction or against access by unauthorized persons.

In our online shop, session identification numbers are stored in so-called session cookies, which are used to save the content of your shopping cart. These cookies are deleted again after you leave the shop or exit your browser program. You can manage the acceptance of cookies on this site in your browser program and block them if necessary.

11. Coupons / Promotions

Redemption of promotional vouchers / codes

  1. Vouchers that are issued free of charge by the seller as part of promotions with a certain period of validity and that cannot be purchased by the customer (hereinafter "promotional vouchers") can only be redeemed in the seller's online shop and only within the specified period.

  2. Promotion vouchers can only be redeemed by consumers.

  3. Individual products can be excluded from the voucher campaign, provided that a corresponding restriction results from the content of the campaign voucher.

  4. Promotion vouchers can only be redeemed before completing the order process. Subsequent billing is not possible.

  5. Only one campaign voucher can be redeemed per order.

  6. The value of the goods must be at least equal to the amount of the campaign voucher. Any remaining credit will not be refunded by the seller.

  7. If the value of the campaign voucher is insufficient to cover the order, one of the other payment methods offered by the seller can be selected to settle the difference.

  8. The credit of a campaign voucher is neither paid out in cash nor is interest paid.

  9. The campaign voucher will not be reimbursed if the customer returns the goods paid for in whole or in part with the campaign voucher within the scope of his statutory right of withdrawal.

  10. A transfer of the campaign voucher to third parties is permitted. The seller can, with discharging effect, make payments to the respective owner who redeems the gift voucher in the seller's online shop. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, legal incapacity or lack of authorization of the respective owner.

  11. The minimum age for redeeming campaign vouchers is 18 years.

 

Redeeming gift vouchers / discount codes

  1. Vouchers and discount codes that can be purchased via the seller's online shop (hereinafter "gift vouchers") can only be redeemed in the seller's online shop, unless otherwise stated in the voucher.

  2. Gift vouchers and remaining balance of gift vouchers can be redeemed by the end of the third year following the year in which the voucher was purchased. Remaining credit will be credited to the customer until the expiry date.

  3. Gift vouchers can only be redeemed before completing the order process. Subsequent billing is not possible.

  4. Only one gift voucher can be redeemed per order.

  5. Gift vouchers can only be used for the purchase of goods and not for the purchase of additional gift vouchers.

  6. If the value of the gift voucher is insufficient to cover the order, one of the other payment methods offered by the seller can be selected to settle the difference.

  7. The balance of a gift voucher is neither paid out in cash nor is interest paid.

  8. The gift voucher is transferable. The seller can, with discharging effect, make payments to the respective owner who redeems the gift voucher in the seller's online shop. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, the legal incapacity or the lack of authorization of the respective owner.

  9. The minimum age for redeeming gift vouchers is 18 years.


12. Notice


The law of the Federal Republic of Germany to the exclusion of the UN sales law applies to contracts between the seller and the customer.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship between the customer and the seller is the seat of the seller.
